1. Introduction and Acceptance

Welcome to Aeolian ("the Service," "we," or "us"). Aeolian is a software tool designed to convert multimedia files from user-controlled personal cloud storage (e.g., OneDrive, AWS S3, WebDAV) into podcast-standard RSS feeds.

By registering an account, accessing, downloading, or using the Service (including Free, Pro, or Ultra plans), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to any part of these Terms, you must stop using the Service immediately.

Important Notice: Aeolian acts solely as a Data Connector and Format Converter. We do not provide cloud storage space and do not permanently host your audio or video files. You are solely responsible for all fees, risks, and legal liabilities associated with the third-party cloud storage services connected to this Service.

2. Description of Service

2.1 Service Mechanism

The Service functions as "middleware" between your cloud storage and podcast clients. Our core functions include reading metadata from your designated cloud folders, generating RSS XML files, and providing access proxies or redirect links.

2.2 Caching

To optimize playback experience and reduce request pressure on your source origin, we may use edge network technologies (such as Cloudflare KV) to temporarily cache download direct links for media files (typically for no more than 50 minutes). This activity is intended to accelerate transmission and does not constitute content storage or hosting services.

2.3 Dependencies

You understand and agree that the normal operation of the Service relies entirely on the API availability and stability of the third-party cloud storage providers you connect (e.g., Microsoft, Amazon, or your WebDAV provider).

3. Account Registration and Security

3.1 Account Creation and Login

You may register an account via email or log in directly using supported third-party authentication services (e.g., Microsoft, Google, GitHub).

  • Regardless of the registration method, you promise to provide true, accurate, and current registration information.
  • By logging in with a third-party account, you authorize us to access your basic profile information (limited to email address, system default avatar, or nickname) from that third party to create your Aeolian account.
  • Note: The Service does not provide functionality for users to upload custom avatars or modify nicknames directly. Your account profile data is strictly synchronized from your identity provider or generated by the system.

3.2 Credential and Key Security

  • We use industry-standard encryption technologies (such as AES-256) to store your cloud drive authorization credentials (Access Keys, Refresh Tokens, etc.).
  • Your Responsibility: You are responsible for maintaining the confidentiality of your account login information. We are not liable for any loss or damage arising from your failure to protect your account, including cloud file leakage, tampering, or deletion.

3.3 Identity Identifiers

The User Public ID and Feed URL Token generated by the system are the unique credentials for accessing your private content. Do not publish Feed URLs containing Tokens on any public index websites or social media unless you explicitly understand and are willing to bear the privacy risks involved.

4. User Conduct and Legality

You agree to comply with all applicable laws and regulations when using the Service and promise not to engage in the following activities:

4.1 Copyright Infringement (Zero Tolerance Policy)

  • It is strictly prohibited to generate public Podcast Feeds for distribution using copyrighted content (including but not limited to movies, commercial audiobooks, pop music) for which you do not own the copyright or have not obtained legal authorization.
  • The Service is designed for personal knowledge management and private backup. Any use of the Service to build "pirated resource sites" or "illegal broadcasting" is strictly prohibited.

4.2 Illegal and Sensitive Content

It is strictly prohibited to transmit content involving violence, pornography, hate speech, fraud, or violations of any applicable laws. Furthermore, the Service enforces the following specific data bans:

  • Biometric Data Ban: You acknowledge that the Service does not have the functionality or security environment to process biometric information (such as facial scans, fingerprints, voiceprints). It is strictly prohibited to use the Service to store, transmit, or distribute any form of biometric data.
  • Sensitive Health Data Ban: It is strictly prohibited to use the Service to store, process, or generate Feeds containing "Protected Health Information" (PHI) or "Consumer Health Data" as defined by the Washington My Health My Data Act.

5. Content Ownership and Authorization

5.1 Your Content (User Content)

You retain all rights to all files, data, and content in your cloud storage. Aeolian does not claim any ownership of your content.

5.2 Copyright Warranty

You represent and warrant that you possess the necessary rights, licenses, or consent to store, process, and distribute all content in your cloud storage through the Service. You agree to fully indemnify Aeolian and its operators against any third-party claims (including but not limited to copyright infringement claims) arising from your breach of this warranty and hold us harmless.

6. Third-Party Service Disclaimers

6.1 API Limitations and Account Suspension Risks

You acknowledge that third-party cloud service providers (such as Microsoft OneDrive) impose strict limitations on API call frequency and traffic.

  • If your Podcast Feed receives excessive traffic (e.g., from being publicly shared), causing your cloud storage account to trigger rate limits, incur high traffic fees (such as AWS S3 Egress Fees), or be suspended by the service provider, Aeolian bears no responsibility for such consequences.

6.2 Service Changes

We have no control over the operations of third-party service providers. If a third-party provider changes their API interface, discontinues service, or terminates integration with us, certain features of the Service may be interrupted.

7. Subscriptions, Fees, and Refunds

7.1 Subscription Plans

We offer different subscription tiers (e.g., Free, Pro, Ultra). The specific feature quotas for each tier (such as number of Feeds, AI usage limits) are as described on the subscription page at the time of your purchase.

7.2 Payment

Subscription fees are charged in advance on a monthly or annual basis.

7.3 Refund and Cancellation Policy

  • Refunds: Except as required by applicable law, all subscription fees paid are non-refundable.
  • Click-to-Cancel: You may terminate the Service at any time by visiting the "Subscription Management" section in your account settings and clicking the "Cancel Subscription" button. We commit that the cancellation process will require no more steps than the registration process. The cancellation will take effect immediately, and you will not be charged for the next billing cycle. Service access will continue until the end of the current billing period.

7.4 Quota Adjustments

Given that features such as AI rely on external high-cost services, we reserve the right to adjust the usage quotas included in each plan level with reasonable notice.

8. AI Feature Disclaimers (For Pro/Ultra Users)

  • Probabilistic Nature: The AI features provided by the Service (including automatic metadata extraction, summary generation, and compliance assessment) are based on probabilistic models. We do not guarantee the accuracy, completeness, or objectivity of AI-generated content.
  • Human Review: AI may produce "hallucinations" or errors. You are responsible for manually reviewing AI-generated titles, descriptions, and categories before publishing a Feed. You bear sole responsibility for any misinformation or disputes arising from failure to review AI content.

9. Intellectual Property and DMCA Policy

9.1 Our Rights

The intellectual property rights of the Aeolian software itself (including source code, interface design, database structure, Feed generation algorithms, and documentation) belong to the service operator.

9.2 Copyright Complaint Handling (Takedown Policy)

As a middleware service provider, we strictly comply with copyright laws. Upon receiving a valid copyright infringement notice:

  1. We will immediately and unconditionally disable the allegedly infringing Feed URL and its corresponding access Token (returning 403/404 status codes).
  2. We will notify the relevant user via email.
  3. For repeat infringers, we will permanently terminate their account without refunding any remaining subscription fees.

10. Disclaimer of Warranties

The Service is provided on an "As-Is" and "As-Available" basis. To the maximum extent permitted by law, we make no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that: (a) the Service will be uninterrupted, timely, secure, or error-free; (b) generated Feed URLs will be perfectly compatible with or indexed by all podcast clients (e.g., Apple Podcasts, Spotify).

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms and your use of the Service are governed by the laws of the location of the Service owner, without regard to conflict of law principles.

11.2 Dispute Resolution

Any dispute arising out of or relating to these Terms shall be submitted to arbitration at the location of the Service owner. The language of arbitration shall be English. The arbitration award is final and binding on both parties.

11.3 Batch Arbitration Procedure

To improve dispute resolution efficiency and reduce costs, if 25 or more similar claims (represented by the same attorney or coordinated attorneys) are filed against Aeolian within 30 days, you agree that the arbitration body (e.g., AAA or FedArb) shall implement "batch arbitration" under its supplementary rules. Cases will be processed in batches (e.g., 50 per batch), and the arbitration proceedings and statutes of limitations for subsequent cases will be stayed until the first batch ("bellwether cases") is decided. You agree this procedure is the sole method for resolving large-scale disputes.

11.4 Class Action Waiver

You agree to resolve disputes only in your individual capacity and waive any right to participate in any class action, representative action, or joint arbitration.

12. Modification and Termination of Terms

12.1 Modification and Notice

We reserve the right to modify these Terms. For material changes (such as subscription price adjustments or changes to dispute resolution methods), we will provide at least 30 days advance notice via email or in-app notification. If you disagree with the changes, you have the right to reject and terminate the Service before the changes take effect. Continuing to use the Service after the notice period constitutes acceptance of the modified Terms.

12.2 Termination

If you violate these Terms (particularly the misuse provisions in Section 4), we reserve the right to suspend or permanently terminate your account without prior notice. Upon account termination, all associated Feed URLs will immediately become invalid.

12.3 Right of Interpretation

To the maximum extent permitted by law, Aeolian and its operators reserve the right of final interpretation of these Terms of Service, service rules, activity rules, and related pages.
